Jamie Foxx, the Hollywood actor, is in hot water again. According to a new TMZ report, court documents show that he has been sued by a woman in a case of sexual assault that allegedly occurred in 2015. The woman’s identity has not been revealed, and she is referred to in court documents as Jane Doe. In August 2015, she claimed that Jamie Foxx assaulted her on the rooftop of the Catch restaurant in New York City. The lawsuit names the restaurant, its employees, and Mark Birnbaum, co-founder of Catch Hospitality Group, as defendants. The woman is requesting a jury trial as well as compensatory and punitive damages.
According to the lawsuit, which was revealed by Rolling Stone on Thursday, the woman claimed that Foxx—real name: Eric Marlon Bishop—dragged her into the back of Catch NYC rooftop lounge and touched her breasts and the area under her pants against her will. According to the woman’s statement, she and her friend were sitting at the Plush restaurant late at night on August 27, 2015, when her friend approached the actor and asked for a photo. Following his response, “Sure baby, anything for you,” Foxx walked over to their table and took a few photos.
Foxx allegedly told the accusor, “Wow, you have that supermodel body” and “You smell so good.” Then, according to the allegations, he drew her by her arm to a private area and allegedly began massaging her breasts beneath her crop top. As she tried to flee, he allegedly reached down her pants and “put his fingers on and in Plaintiff’s vagina and anus.” According to the lawsuit, a security guard witnessed the assault but did nothing to stop it. Birnbaum and Catch NYC are also named as defendants in the lawsuit.
Jamie Foxx has previously been accused of sexual harassment. A woman accused Jamie of sexually harassing her during the MeToo movement, which he denied. This has not been Jamie’s best year. His hospitalization was revealed in April after he suffered an undisclosed “medical complication.” Later, he was called out on social media for what appeared to be an anti-Semitic post.
